DUI Defense

Florida law prohibits drivers from operating vehicles if their normal capabilities are impaired by drugs and/or alcohol. An individual will be charged with Driving Under the Influence (DUI) if they are pulled over and the officer determines through exercises/testing that the individual is impaired.

If you are caught driving under the influence (DUI) in Florida, you may be subject to a number of penalties. These can include fines, jail time, and the loss of your driver’s license. If you are convicted of DUI, you will also have a criminal record.

The penalties for DUI in Florida depend on a number of factors, including your blood alcohol content (BAC), whether you have been convicted of DUI before, and whether anyone was injured as a result of your drunk driving.

If this is your first DUI offense, you may be fined up to $1,000 and jailed for up to six months. You may also have your driver’s license suspended for up to one year. If your BAC was .15 or higher, or if you had a minor in the car with you at the time of your arrest, you may face enhanced penalties.

If you are convicted of DUI a second time, you may be fined up to $2,000 and jailed for up to nine months. Your driver’s license may also be suspended for up to five years. If your BAC was .15 or higher, or if you had a minor in the car with you at the time of your arrest, you may face enhanced penalties.

A third DUI conviction is a felony offense in Florida. You may be fined up to $5,000 and jailed for up to five years. Your driver’s license may also be suspended for up to 10 years. If your BAC was .15 or higher, or if you had a minor in the car with you at the time of your arrest, you may face enhanced penalties.

If you are convicted of DUI and someone is killed as a result of your drunk driving, you may be charged with vehicular homicide. This is a felony offense punishable by up to 30 years in prison.

If you are convicted of DUI, you will also have a criminal record. This can make it difficult to get a job, rent an apartment, or take out a loan. You may also be required to attend DUI school and have an ignition interlock device installed on your car.
